What has not been disclosed are the following facts mitigating the financial position stated and
providing background to the failure of Natcon Developments Pty Ltd to meet payments as and when they fell due..
The circumstances of ND’s demise can be summarized by an accumulation of client’s failing to make final payments for projects completed by ND combined with an overpayment of monies by ND to a trusted associate firm and the resultant legal costs eventually preventing ND from pursuing its rights and clearing its debts.
This resulted in Natcon being unable to pay its debts as they became due and unable to settle them with any substantial benefit to the ongoing viability of Natcon.

The difficulties commenced when a client (Flinn - VCAT Ref: D183/2013) moved into his newly renovated home and refused to make the final payment. The matter was contested in VCAT and
was settled in ND’s favour although legal costs offset any benefit obtained in the win. Effectively this matter resulted in a loss of working capital of approximately $68,000.

Very quickly following this, a developer (Markos Developments & Ors - VCAT Ref: D450/2013) failed to pay for work completed by ND. The developer took possession of units constructed by ND without making the final payment.
This matter dragged out over time and when the hearing became imminent and because of other simultaneous legal actions ND did not have the funds to litigate. The matter required an expert report and extensive preparation. There was a reasonable likelihood of a payout but unlikely to be the claimed amount without expert evidence. This matter resulted in a reduction in working capital for ND of approximately $112,000.

On another project (R & S Scamporlino - VCAT Ref: D1181/2012) the owners took possession of their extensively renovated home without making the final payment. This matter ran for 5 days in VCAT and a further 2 day hearing was set down for final submissions. Because of lack of funds no one attended the final days and a substantial judgment was handed down against the company.
There was a reasonable likelihood of a partial payout in this matter. It effectively meant a loss of working capital of approximately $70,000.

The total amount of working capital lost due to these projects was $250,000 combined with a $120,000 debt that should not have been made

The major blow to the business was in AW Developments
Vic - County Court Ref: CI-14-01074.
Wayne Martin the director of AW Developments
was paid $366,000 to make payments to
creditors on ND’s behalf. AW failed to pay the creditors
and has now claimed $300,000 against ND.
The liquidators are considering whether to challenge this but it is a complex and expensive forensic
accounting exercise. This matter has a reasonable likelihood of a significant payout if it is run.

Conclusion
As the domino effect of matters weighed in on ND , advise was given to wind it up. The legal costs to pursue the rights of ND were overwhelming and, given the position of ND, had to be paid into trust in advance of the work being done.
The final balance would have been progressively reduced with the continuation of work and some would not even be due other that through the liquidation causing the debts to be called in.

Danny Daher is a competent builder and the principal has been in construction for over 19 years
without any previous judgements. The Company has adjusted its business model to reduce the volume of work and reliance on site personnel other than Danny Daher himself controlling the works.

Given that you have now successfully completed the renovation at our house, I thought you

As you may recall, due to our architect "dropping the ball" we needed to find a builder at short
notice. When you received my call for help you responded immediately and efficiently and
provided a very competitive quote. We decided to go with you (although we had other quotes)
and have never regretted it. In particular, you and your team:
• were always polite and punctual;
• followed through on commitments;
• addressed any issues that arose in a prompt and pleasant manner; and
• were easy to communicate with.
I would also like to commend you on James, your project supervisor. He was charming and

RE : Construction of a new outbuilding.
To whom it may concern,

After having been through the building process several times before and vowing not to engage another incompetent builder, I bit the bullet and contacted Natcon constructions from an add in the local paper.

I made the phone call and Danny Daher from Natcon was at my front door within a few hours. He inspected the site, we discussed my plans and he gave me ideas and advice while staying focussed on what I wanted to achieve. The promptness, politeness and the professional attitude definitely left me feeling confident. The quotation was reasonable and within the ballpark of what I expected to pay, but it was the builder’s willingness and professionalism that won him the job at the end of the day.

The paperwork was completed and the construction of the building commenced. It was important to me that the new building matched the existing residence, original materials were sourced by the builder or matched as close as possible.

I was kept informed every day – who was turning up and what they were going to do. Any concerns that I may have had were addressed immediately, in most cases the builder had already attended to these issues.

Danny is not just a great builder but a great guy who I found to be very approachable and friendly. He built my extension to same high standards as if he were building it for himself. The building experience with Natcon has left a very good taste in my mouth and I would have no reservations in using their services or recommending them to anyone that is looking to build.

Danny Daher is now associated with another company which was registered in May 2014 called Bilby Constructions Pty Ltd.
He is currently working on a project in connection with that name - Bilby Constructions.

This build was the same as the rest of Natcon's builds, defective workmanship, not performed as per the plans and specifications contained in the contract and considerably delayed, often costing considerably more than the original contract price agreed.

Due to the delays created by Danny Daher, no doubt as evidenced in all of the other Danny Daher / Natcon Developments VCAT cases, the case was never finally determined as Natcon Developments was pushed into Administration by the earlier case below.--

Danny Daher needs to be jailed for his actions, he is a con artist and a pathological liar. He preys on people deliberately with the sole intention of taking whatever he can from them and does this in a cold pre meditative manner. To our knowledge Danny Daher has repeatedly shown these exact behaviours to almost every client who has been unfortunate to sign on of his scam building contracts.--

This was evident in Flick On serving Natcon with a Statutory Demand in the Supreme Court in 2013 for failure to pay debts of around $60k, there is also the matter of the hundreds of thousands of dollars that were owed, at this time, by Natcon to other trades (as evidenced in the Worrells administration file).

Given the money Danny Daher owed to the trades back in 2013, it is very surprising you are suddenly claiming in August 2014 that Wayne Martin misappropriated the funds to repay outstanding debts 6 months to a year after the debts were already overdue. Why would Danny give the large single payment to Wayne to pay the trades directly himself? Why didn't Danny Daher just pay the trades himself, seeing as he had all of the money from the clients sat in his account? Oh, yeah right, lawyers, investment properties and your swimming pool, plus setting up Natcon Ten Pty Ltd so that you could carry on trading when you became the loser in VCAT. Danny's claims against Wayne are simply lies along with every other word and sentence in this feeble claim.--

These ongoing actions by Danny Daher will only increase the debt owed and litigation required, reducing the potential for progressively reducing your debts as claimed. It is clear you are not a competent builder. Competent builders do not have 100% of their clients ending contracts, claiming on warranty insurance for structural defects, signing settlement deeds just to get rid of the builder or having significantly structurally defective homes that are not even built to plans and specifications.--

When we started talking about the merits of “going up” in our place, it made sense to give your office a call, and we are so glad that we did. Our project is all but complete, and may I say that we are absolutely thrilled with the final outcome. We have to pinch ourselves that we are now living in this magnificent home, and that Natcon helped realise this dream. Every interaction we had with a Natcon employee or consultant was a positive one, and the project ran seamlessly from our first meeting with Danny , to Contract Stage and then to final / Practical Completion. Danny was an absolute pleasure to deal with. We just clicked with Danny from our very first meeting. He listened carefully to our requirements, offered suggestions and recommendations when asked, and came back with an outstanding design ideas that hit the mark straight up. He obviously has a wealth of experience, and this showed as he carefully steered us through the the process, and at all times made us feel comfortable and informed. We have received so many compliments on the build. As regards the construction management process, we were very fortunate to have had Danny to deal direct with for our project. Put simply, I can’t speak highly enough of Danny. He was professional, courteous, respectful and knowledgeable. He always managed to respond to my (many) emails, texts and phone calls in a timely manner, and never ever got flustered. Despite the number of projects he was managing, he always made us feel like we were his only client and that says a lot about his organisational skills. When we were told a certain trade or subcontractor was to be on site, they always arrived on time. Danny obviously has a strong work ethic. He was onsite almost daily overseeing the works, and ensuring those works were completed to exacting standards. It is clear he has a lot of pride in what he does, and this was evident from the way he conducted himself each and every day. We have received so many compliments from neighbours and people passing by, all of whom have congratulated us on the design, and most are in awe of just how quickly it all went up! We completed well ahead of schedule, and on budget. It really was an absolute privilege to work with your team, and I can only hope they enjoyed working on our home, as much as we enjoyed working with each of them. I wish Natcon all the Page 2

You pocketed all the payments you received from clients without delivering the goods and services, and left houses full of defects and complete mess (Daher – do you know there is this large open-topped waste container designed to hold loads of construction and demolition waste or other waste and litter types known as SKIP BINS????).

You are running around telling lies to tradies and suppliers that your clients have not paid the invoices – the standard excuse you make for not paying your suppliers and trades. Where are all the monies you have taken from your clients??? Which bank accounts (here or overseas?) have you stashed the money you “stole” from your clients while not paying your trades/suppliers? You are a scum, a liar and a thief!

You call yourself a “professional builder” in your pathetic website – what is COLOSSAL joke! You should have called yourself a “professional cowboy builder” – that is exactly what your qualification is. By the way, the word “quality” does not even exist in your work, Daher. Even a kid can build a house using LEGO blocks better than you can ever achieve as a builder.

Where did you get your builder qualifications? Because damn, that “school” you went to did an absolute SH^T job in educating you. You are totally incompetent and hopeless in your job - it is a total joke and disgrace to your fellow builders. You can’t use a spirit level, you can’t use a hammer, you can’t read plans, you can’t read product manuals, you can’t do simple maths, you can’t use the humble tape measure (pull the yellow bit out – it has numbers on it – I’m sure they are important), you don’t understand basic 101 building principle - door frames need lintels!!!! Hey Daher - what happened to your website? You didnt pay your internet service provider? That is your usual trait isn't it - like you have not paid your trades/suppliers. Did you not even notice that your website is now suspended. Are you doing your disappearing act again? Where did you pocket the sale of your house trailer earlier this year? In your misses' pocket again?

I hear that someone with the initials DD recently sold a flatbed horse trailer - for $7,500. any disgruntled creditors get out to Balnarring ASAP and claim some cash. This may be the last cash he gets for a while, as I understand there is a posse of lawyers about to circle him in a pincer move!
