Caller: Aussie Lawyers Dear Reverse Australia – Legal/Support,
I refer to my concerns notice under s 12A of the Defamation Act 2005 (NSW) and my follow-ups, most recently on 30 September 2025, concerning the third-party comments published on your service about the mobile number 0402 004 086 (including all variants of that number on your site).
You have not provided any substantive response. Your automated messages about surname matching, “report” icons and seven-day processing are irrelevant to a defamation takedown. You are a publisher at law of the comments you solicit, host and moderate. The High Court in Fairfax Media Publications Pty Ltd v Voller [2021] HCA 27 makes that position plain. Once notified, any reliance on innocent dissemination is untenable. Each continued display is a fresh publication and aggravates damages.
The comments in issue accuse our firm and its practitioners of being a scam/fraud and assert the number is disconnected. Those statements are false. They carry defamatory imputations of dishonesty and unlawful conduct. The serious harm threshold in s 10A is satisfied. The harm is ongoing and measurable: prospective clients search our lawyer’s number and are met with your page repeating these allegations, resulting in diversion of business and reputational damage.
You were put on formal notice. You have chosen not to act. That stance is unreasonable, aggravates harm, and will be relied upon in support of aggravated damages and indemnity costs. Your insistence on treating this as a “listing” issue is misconceived. This is not an opt-out of a directory entry. It is a defamation takedown demand to a publisher.
This is a final pre-action demand. Within 24 hours of transmission of this email you must:
(1) remove the entire comment thread relating to 0402 004 086 across all URL variants and formats on your service. Here is a link to the offending URL: https://www.reverseaustralia.com/lookup/0402 004 086/
(2) disable further public comments for that number and apply pre-publication moderation to prevent republication.
(3) purge your caches and lodge search-engine removal requests for cached copies.
(4) publish a short correction on the same URL acknowledging that the false comments have been removed.
(5) provide written confirmation of the precise time each step was completed, together with the full name and physical and electronic addresses for service of your legal officer or external solicitor.
Preservation notice: preserve all data and records concerning the comments and your handling of this matter, including timestamps, IP addresses, user-agent strings, account identifiers, edit histories, moderation logs, internal tickets, and correspondence with any third party (including registrar, CDN and host). Do not alter or delete anything.
If you fail to comply by the deadline, I will file in the Supreme Court of New South Wales without further notice seeking urgent interlocutory injunctions restraining publication, final relief, general and aggravated damages, delivery up, interest and indemnity costs. I will also seek ancillary orders for disclosure and identification, including preliminary discovery under UCPR rr 5.2 and 5.3 to identify the wrongdoers and to compel production of the data you have been directed to preserve. In parallel, I will notify and proceed as necessary against your registrar and network/CDN concerning continued publication after notice. Additional causes of action, including injurious falsehood and relief under s 18 of the Australian Consumer Law, are reserved.
