Trademark infringement notice email by using this mobile number

In line with our company policy, we are giving you first priority to file the trademark due to your legitimate and established use. However, time is of the essence, and we require a response within the next 24 hours if you wish to proceed with the filing.

Here’s the situation:

* If you proceed: We will immediately file your trademark application through IP Australia, ensuring you secure exclusive ownership and legal protection of the name.
* If you do not respond: We will move forward with the other party’s filing, as IP Australia operates on a first-to-file basis.

If the other party secures the trademark, they will gain exclusive rights to the name, and you will no longer have the legal right to use it. Under the Trade Marks Act 1995, this could result in severe consequences, including:

* Cease-and-desist orders, requiring you to stop using the name immediately.
* Rebranding costs, affecting your business name, marketing materials, and branding assets.
* Legal action, exposing you to potential claims, penalties, or damages.

We strongly recommend you act now to safeguard your rights and avoid any business disruption. If we do not hear from you within 24 hours, we will proceed with the other party’s application, as we are unable to delay the filing process indefinitely.

To proceed or if you have any questions, please reply to this email or contact front desk at (08) 7092 6844 and ask to be connected to me directly.

We urge you to act promptly to protect your business and secure your rights.

From domain name: markfilerau.com

Dear <business owners name>,
I hope this email finds you well.
We are reaching out regarding a critical matter concerning the trademark application for "<COMPANY NAME>" Another party has recently approached us to file a trademark application for this name. Upon conducting thorough research, we found that they are a new startup and have been using the name for only a few months.
In contrast, our research indicates that you have a legitimate and proven history of using this name for an extended period. As per our company policy, we are giving you first priority to file for the trademark, as your claim to the name is significantly stronger.
Here’s what you need to know:
• If you wish to proceed: We can file the trademark application through IP Australia immediately, ensuring you secure exclusive ownership and protection of the name.
• If you choose not to proceed: We will move forward with the other party's application, as IP Australia operates on a first-to-file basis. However, we strongly advise against this, as it could lead to serious legal and operational consequences for your business.
If the other party secures the trademark, they will obtain exclusive rights to the name, and you may no longer be able to use it freely. Under the Trade Marks Act 1995, this could expose you to potential trademark infringement claims. You could face:
• Cease-and-desist orders, requiring you to stop using the name.
• Rebranding costs, including changes to your business name, marketing materials, and digital presence.
• Legal action, which could result in penalties, damages, or injunctions.
We strongly recommend acting swiftly to secure your rights and avoid the risk of a legal battle. The first-to-file principle means we cannot delay filing indefinitely.
If you would like to proceed, please let us know as soon as possible so we can begin preparing your trademark application. Should you have any questions or need further assistance, feel free to contact us via this email or call our front desk at (08) 7092 6844 and ask to be connected to me directly.

Thank you for your prompt attention to this matter. We look forward to assisting you in protecting your business.

Calling and email Australian businesses to say that they're infringing on Trade Marks but they can fix the issue. Don't get involved with this scam.

Dear xxxxx,

I trust this email finds you well.

We are contacting you with an urgent final notice regarding the trademark application for "xxxxxxx" As previously mentioned, another party has initiated the trademark filing for this name. However, after conducting thorough research, we discovered that they are a recent startup with only a few months of use. Here’s the situation:

If you proceed: We will immediately file your trademark application through IP Australia, ensuring you secure exclusive ownership and legal protection of the name.
If you do not respond: We will move forward with the other party’s filing, as IP Australia operates on a first-to-file basis.

Legal action, exposing you to potential claims, penalties, or damages.

Received a legitimate looking email regarding someone attempting to file a trademark for my business name - it included my personal name and business name.
Luckily I googled the provided contact phone number and found the list of previous complaints.
