I received this. It is a registered and licensed digital asset business called Maher and James, with offices in Sydney CBD. I am putting this up because they've helped me considerably with my investments over the last twelve months. This is NOT a scam; it is a legitimate and fully licensed trading business.

These comments reflect a misunderstanding of how “spot” cryptocurrency is regulated in Australia. Spot crypto is not considered a financial product, and as such, it does not fall under ASIC oversight or require an AFSL. ASIC regulation applies to derivatives and futures because those instruments are classified as financial products, regardless of the underlying asset.

Maher and James Capital does not manage money for investors. The business operates on a trading ideas and execution-based model, where clients independently decide — through their own discretion and due diligence — whether to participate in the trade ideas presented. Trades are then executed through a third-party, fully AUSTRAC-registered Digital Currency Exchange (DCE).

Regarding licensing, ASIC released a consultation paper earlier this year outlining potential future frameworks for crypto regulation. That document was updated only a few months ago and is still in draft form, meaning it may be revised again before any policy is finalized.

As for the company’s tenure, Maher and James Capital does not claim to have been in operation for 10 years. The reference relates to the combined industry experience of the founders, who are well-established professionals with verifiable profiles and networks on platforms such as LinkedIn.

From my understanding and unpacking of their model, they appear to fit well within the framework of the current legalities surrounding crypto. Additionally — and a big plus in my view — they have an office in Sydney, which I personally visited before investing. I came across your comments and thought I’d respond to provide some clarity.

Are you serious. They had not been in Business 12 months as at when you posted that nonsense. Let alone the 10 years they are now claiming on their blurb. Check out ASIC for more details and they ARE NOT registered., They hold no financial license period.

They do not hold an AFSL but instead rent one through a loophole, allowing them to operate as an Authorized Representative. They have never worked in a legitimate brokerage firm—only in boiler rooms, where they buy and sell data. They obtain contact lists by purchasing them, which is how they get our details.

Definitely a scam caller. Don't answer. The earlier reviews are obviously done by the scammers as they are conveniently all done on the same day. I'm sure that most people who know a company is not a scam would not be searching their number, going to a site that is all about reporting scams and then be so loyal to the company as to write "this is definitely not a scam, Im a customer!" Sounds perfectly legit...

Have received 4 text messages from “Zara” claiming to be from Maher and James Capital. “Hey Nigel, Sorry I haven't been able to get a hold of you yet, I've recently taken over the accounts at Maher & James Capital and wanted to make sure everything was up to standard? 😊”
If legit, wouldn’t Zara realise by now she has a wrong number? Or try contacting Nigel by email or ph call? I emailed the company and not had a response
