I noticed recently an "international" Hairchoice franchise job advertised on Seek.com. The job looked serious, as was its remuneration.

Hairchoice was promoting its global ambitions, and how its proven formula is about to conquer the world. The comments on this thread and the "A Current Affair" piece (attached below) seem at odds with this international expansion goal?

Narnia Investments Pty Ltd (Narnia) and its sole director, Mr Simon Clarke (Mr Clarke), have provided a s87B Undertaking to the ACCC in conjunction with the settlement of civil court proceedings taken against them by the ACCC.

Narnia and Mr Clarke were found by the Federal Court to have engaged in misleading and deceptive conduct pursuant to section 52 of the Trade Practices Act.

Injunctions were imposed by the Federal Court against Narnia and Mr Clarke.

Mr Clarke was also ordered to undertake trade practices law compliance training.

The conduct concerned Narnia (which formerly controlled Advanced Hair Studio in Hobart) and Mr Clarke making false and misleading representations regarding a vulnerable consumer's right under his contract with Advanced Hair Studio Hobart to terminate the contract and obtain a refund of his deposit monies.

Under the terms of the consumer's $15,500 hair replacement contract with Advanced Hair Studio Hobart, the consumer was entitled to terminate his contract and to receive a refund of his deposit monies in circumstances where no hair treatment had actually commenced.

The s87B Undertaking provided by Narnia and Mr Clarke requires them to pay the affected consumer the $5,000 balance of $10,000 damages previously agreed between the ACCC and Mr Clarke ($5,000 has already been paid) and to refund the consumer his $1,800 deposit.

The Undertaking also requires Narnia and Mr Clarke to pay the ACCC's legal costs in the sum of $12,785

13-258MR Melbourne man convicted on charges of managing a corporation while disqualified

Mr Simon Charles Clarke, of Northcote, Victoria, has been convicted in the Heidelberg Magistrates Court after pleading guilty to two charges of managing a corporation while disqualified. The charges were brought following an investigation by ASIC.

In April 2009, Mr Clarke was fined and convicted of a contravention of the former Trade Practices Act 1974. As a result, Mr Clarke was automatically disqualified from managing a corporation for a period of five years.

Mr Clarke pleaded guilty in June 2013 to managing Melbourne-based company Hair Choice Pty Ltd while disqualified between 11 November 2009 to 3 November 2010. Mr Clarke was fined $3,000 and ordered to perform a community correction order for 24 months.

‘This action demonstrates ASIC’s resolve to ensure those who are disqualified from managing companies do not flout the law,’ ASIC Commissioner Greg Tanzer said.

The matter was prosecuted by the Commonwealth Director of Public Prosecutions.


Background

ASIC’s investigation found Mr Clarke had made decisions that affected the whole, or a substantial part of the business of the corporation, and exercised the capacity to significantly affect the corporation’s financial standing while being disqualified from doing so until 22 April 2014.

To all readers of this blog, my name is S..S..SSimone C. Clark. Sorry, that should be The Great S..S..SSSimone C. Clark; entrepreneur, visionary and all around hair loss industry guru and legend.

I am sick and tired of visiting this site only to find defamatory and misleading information being said about a person people keep mistaking for me.

As such, I have decided that it is about high time I cleared the air, set the record straight and revealed the truth about my history, the actions I have taken and the people that I have wronged so that people finally realise that, I Simone C. Clark of HAIR DECISION, is NOT this other person you all keep talking about.

Firstly, I worked for a significant hair loss company for over 20 years. During that time I helped establish a sales policy that required sales personnel to initially quote customers $29,000 for hair replacement programs that cost less than 1/10th of that. If those customers did not agree to such exorbitant pricing, the business model I created required my sales staff and I to employ intimidation and harassment tactics to get them to sign. If these tactics still failed to result in a sale, and the customers were at least 70 years old and feeble, I would even resort to pushing them down stairs to get my way!!! I would even modify contracts after they had been signed by customers, if it would help get more money into my pockets.

Throughout my time at this company the legal team would often have to be called in to protect the company from the legal f*ckups I created. Eventually one such f*ck up lead me to be fired from the company. The truth is I sold a program to a mentally disabled person and when the sale was challenged in court I decided that it was best to lie because, at the time, I believed that I was the smartest girl in the room.

Unfortunately, however my arrogance proved my undoing, as I was not only subsequently fired but I was found guilty of perjury and, in accordance with Section 206B of the Corporations Act, I was automatically disqualified from managing any corporation for 5 years.

This restriction is basically similar to a person that declares bankruptcy. As such I:

• Am prevented from being involved with any significant decisions of a business. I cannot manage staff, cannot hire staff, cannot open bank accounts, give instructions to lawyers, accountants etc.

• Cannot be in any position within a business where customers, suppliers, third parties, employees or management perceive me as having any management powers.

• My interaction with professional advisors and staff must be tightly controlled.

• Should not be authorising any actions and signing documents.

• Should not have any business cards indicating a management role.

• Should not have a business email account.

• Cannot sign anything!
In fact, I cannot have any decision-making ability within ANY company AT ALL !!!

However, despite this restriction, before leaving this company I set up HAIR DECISION in direct competition to my previously employer. This occurred in 2009. Over the next 5 years, via a process of false advertising, misleading and deceptive conduct and false promises I managed to obtain over $5m dollars from unsuspecting investors, all of which has since disappeared due to my greed, lies, and the need to pay off my personal legal fees. Not to mention my habit of funnelling this money into family trusts and overseas bank accounts. But shhhh…..that’s our little secret!!

The following list identifies most of the investors that I have stolen money from. However, to ensure I protect the innocent (i.e. me!!) I have only used their initials:

Despite my directorship restriction I continued to direct the activities of HAIR DECISION Australia via my co-conspirator Pauline DeMarco. She selflessly ‘acted’ as Director of the company whilst I withdrew of $1m in personal payments from the company in the capacity of "Shadow Director". Pauline even paid herself $240,000p.a. in the process!!!

Eventually Pauline and I ran HAIR DECISION Australia and its parent company HAIR DECISION Limited into the ground. But don't think that stopped us. Oh no, I continued to act as the Director of HAIR DECISION NZ and Pauline continued to act as the Director of HAIR DECISION Australia whilst it traded insolvently!!!

Unfortunately, my lies and deceit eventually caught up with me again. In 2012 the Department of Public Prosecutions evaluated bank account opening forms, interviewed HAIR DECISION staff, HAIR DECISION investors etc. and determined that I had breached my restrictions. Duh !!!!

As such, I was subsequently charged for my conduct up to June 2012 and, as a result, my restriction has been extended by a further 3-years from the date of conviction. This takes my directorship restriction to 31 July 2016.

Since then Pauline and I recently decided to place HAIR DECISION Australia into liquidation without telling any of the investors that we have done so!!! Boy I hope they don’t find out!

Pauline did this because she realises that as a fully qualified accountant, should ASIC find out she managed a company that was trading insolvently, then she would be, like me, in serious trouble. Hell, I won’t even mention the fact that HAIR DECISION Melbourne was also trading insolvently. Oh sh*t….I just did !!

So that now brings us to the present. Currently I have about 6-7 new employment / investment opportunities in my brand spanking new business, HAIR DECISION Franchising, being advertised on www.seek.com.au. Each investment is only for a meagre $285,000 and in return you get a guaranteed $1 beeeelion dollars (pinky finger near corner of my mouth) salary in only the first 4 weeks!!!!

Mwah Ha ha !!!

Please respond and let’s together bring transparency and honesty to this unscrupulous, immoral, exploitative and industry !!!!

Overdue transparency

What commercial loss???

Hairchoice started in 2009 and went into liquidation 08/10/2013 (see link below).
Hairchoice couldn't even pay its bills so it shut down to avoid creditors. Why is Simon Clarke now worried about commercial loss - he he he, Simon's so funny.

So much for world hair loss industry domination, over the last 5 years Simon Clarke could not even keep one studio viable.

Someone needs to tell him to wake up and smell the roses!!!
He is the Godfather of the "Unscrupulous global hair loss solution industry" - well really just the Unscrupulous bit.

Reason:
1. He is the only person I have ever heard to say 'Unscrupulous global hair loss solution industry'. he also can't spell Unscrupulous.
2. He continues to claim he was the 'Head Honcho from Advanced Hair', which is not true. He was just a con man dressed as a nasty sales manager
3. He always talks himself up as a Big Wig, but unfortunately he just wears one.

Liar, Cheat and Thief. Only a matter of time before it all catches up with Simon. What a criminal!

If not, DO NOT BELIEVE anything Simon Clarke states or promises, even when it is in a contract he has drafted.

When a word is excessively overused - like guaranteed - it is being used for another purpose = trick investors into handing over money they will never get back.

I am one of those that has been burned as an investor and employee.
