I have called scam watch, and they have had a few calls about this, they could no say if it was a scam. They said to call D&B and check with them, so I did and they said they were a client. But its still seem like a scam to me, I ant to the Getty web site and with big letters it said "Royalty - Free images" so it looks like a scam to trick people to use the images and them hit them with legal action to recover an made up large amount from small businesses. Whats worse is that they are still doing this and D&B are the strong arm to make this happen. How they can get away with this is crazy, trick the public and then try and extract money out of them. Their must be about a dozen consumer laws that have been broken, but still they continue. Im willing to puit my money into a class action against them. Each person that this happens to will pay or take it to court, in the end their will be money paid to solicitors or to getty, Why not team up and take action apon them, its will most likely be cheaper, their is no way that our consumer laws will allow this to keep happening if brought ti their attention.

There is a name for this and it's called "speculative invoicing" - even though Dun and Bradstreet are debt collectors, this is one step worse. Acting on behalf of Getty they demand $X (usually quite a large amount) for illegal use of their copyright images - without 1) proving copyright ownership and 2) indicating in any way how they came to arrive at $X. Complain to the ACCC about D&B and contact the Carlyle Group who own Getty to complain - Simon Moore is their Australian rep in Sydney. I am sure he would love to hear from you. Other US firm are taking the same approach with pirated films in Australia - this is not about compliance, but simply money.

They dropped off a letter by hand two weeks ago, demanding $913.00 and have had several phonecalls from them but I have refused to engage. We have removed image from website which was done by our developer using their image library. This morning we asked them to send us a tax invoice with a registered ABN, proof that they own copyright, a registered address to send mail to and the name of the solicitor who is in charge of the "case". They hung up and said they would call back later.

Scam call and frightening extortion attempt. Threatened me over a false claim of copyright infringement on behalf of Getty Images.

A debt collection service like dun and Bradstreet can not, and are not permitted at law, to call you more than 3 times in a week (or 10 times in the same month) in any state or territory in Australia.

The government authorities and ombudsmen will help you.

It is a proven, quick and easy way to stop dun & Bradstreet if responsible, legally.

They also hide their number.

And this can easily be traced back to them now.

So
get the evidence: count how many missed calls you received,
trace each call back with your telecommunications provider who will reveal the caller,
then complain to the authorities about this debtor harassment ( as big fines apply)

But remember there is no debt in the true sense.

So calling you may also attract the ACCC’s powers for deception or similar practice under consumer laws in Australia.

And, how did they get your phone number?
For example, as no credit was given, there is no credit extension (unlike a bank, telco etc), then they could be breaching your credit report by accessing too.

This attracts other fines and penalties on The caller.

This number called me today claiming I owe $913 in compensation for 1 copyright (GettyImage) image on my webpage, which I took down immediately not knowingly it was copyright,

I disagreed with paying this and he then said we can settle this for $198 with 7 days to pay, and said there won't be any more phone calls from then if I did so! I also declined. He then said to email Gettyimages for further disputes, gettyimages@d&b.com.au which I never.

All phone calls are to be ignored from private calls and 1300 315 866 & 1300 315 994 - these numbers are clearly scams!!

I also received a letter in the post posing as Dun & Bradstreet the week prior in regards of tax income owing, the number on the letter lead to 1300 315 994 for payments..

Hopefully this experience helps!

Jenny, the ATO does use Dunn & Bradstreet, Collection House and Probe to name just a few to collect debts on their behalf. If someone does ring you and you aren't sure, just ring the ATO and give them your details (you will need TFN and a document with a reference no. on it ie. tax assessment) and see if you do owe any money. You can then deal with it. You may be told that you have to deal with the debt collector, or if your debt is under $25,000 you can use the automated service to set up a payment plan.

Hope this helps.

Given I have never to my or my businesses knowledge used Getty for images came to this sight to look it up and am glad I did. I assumed it was a scam... Thanks for the heads-up. Next time they call they will be blasted. Also emailed Getty Images and asked them to confirm use of D&B. Will see what happens.

1300 315 866 is a scam.
They say they are Dun & Bradstreet- but the number for Dun & Bradstreet 132 333
After getting a call I called Dun& Bradstreet on 132333 & they knew nothing about this matter.
Also if you google 1300 315 866 there is a whole thread on whirlpool - this is a scam.
Let's face it Dun & Bradstreet do not call & ask to speak to the manager - they know who the company owners are & contact them they don't call a number & company name but no personal name & ask for your name.
Also when I specifically asked about the image in question - they described a photo that we had taken ( my friend is a photographer).
If you call the 1300 315 866 number it doesn't even say Dunn & Bradstreet it says something about Getty Images.
Also if you ask too many questions they just hang up.
My advise don't pay them a cent & report to scam watchers.
These people should be ashamed of themselves.

I received a letter yesterday claiming to be from Dunn and Bradstreet saying that my ATO payment was 4 months overdue and they were commencing legal action. I rang 1300 315 994 - the number on the letter. The woman I spoke to didn't seem to know anything about me, just kept asking me questions such as 'what is your tax file number, what is your address, what is your phone number." Believing it was genuine I gave her all of the information she requested. I then rang my accountant who told me I have never owed any money to the ATO and that all of my payments are up to date and always have been. He suggested that the letter was intended to obtain my personal details to capture and use my identity. Has anyone else experience this?

Just got my first call from them, luckily i couldn't answer it, they left a message. I will track their calls and get in touch with local member of parliament and ombudsmen.
Dealt with Getty Images before their bill went from $2500 to $300 and they never sent the bill. So yes I agree they are scams.
Have you had further contact from them?

I have had the same scam attempt by Dun & Bradstreet on behalf of Getty since late last year. I have gathered evidence against all of their claims and clearly shown they are in breach of not only consumer law but possibly fraud law also. I have shown evidence of their claim amount being too high and that accidental use is a true and legitimate defence under copyright law. I have also shown many other examples of other images on similar license terms are FAR less than what they claim. Their latest come back is that the amount they claim they are owed, $913.00 (sound familiar) was calculated using their online calculator. Trouble is I went made the same calculation well before they thought to use this as their latest ploy and can show evidence of them not only calculating it off the wrong license type but also at the right license type, it is still an amount still far below what they claim the image is worth! They are scammers and rely upon their threat of litigation as their tool. Interestingly I found that Getty is in fact guilty of the very thing they are chasing all of us for. See this link here http://www.abc.net.au/news/2013-11-23/photographer-wins-241.2-mln-from-companies-that-took-pics-off-/5112824 They "accidentally" stole some images from Twitter! I am not paying their demands, nor should anyone else, total fraud. Does anyone know of any law firms etc that are dealing with this scam as I feel we need to come together on this and see that our government regulators and the like put an end to this.

Unfortunately I verified that the image was owned by Getty Images but they would NOT inform me as to how the amount was calculated...I got an 80% discount to pay on the spot, but I admit, I feel sick. No notification, no warning, a first offence and only one image ever accidentally used across three websites dating back to 2001.

This is a scam, trying to trick people into paying money for images that have been bought and paid for. They tried to make me pay for an image my photographer took.
